SC refuses to stay new procedure for appointment of Election Commissioners

Supreme Court on Thursday dismissed application seeking a stay on the new procedure for appointing new election commissioners.

It issued notice to centre on application questioning constitutional validity of the Chief Election Commissioner and Other Election Commissioners Act, 2023.

Supreme court in its March 2023 verdict, ruled that appointment Election Commissioners and Chief election commissioner should be based on advise rendered by committee comprises of  Prime Minister, the CJI and the Leader of Opposition in Lok Sabha until a law is made by the Parliament. While dismissing application questioning exclusion of Chief Justice of India from the committee to appoint Election Commissioners, SC affirmed that it is an interim arrangement till centre enacts law in this regard. 

SC also questioned the procedure followed by Centre in appointing Members of Election Commission of India.
